HUNTSVILLE, TEXAS — A 46-year-old death row inmate, Jamaal Howard, has been executed by lethal injection in Texas, despite last-minute legal efforts by his lawyers to halt the punishment over concerns about the drug used in the procedure.
Howard was pronounced dead at 8:03 p.m. local time on Wednesday at the Texas state prison in Huntsville, becoming the first person executed in the United States since the botched execution attempt of Tennessee inmate Christa Pike the previous week.
Howard’s attorneys had urged the courts to suspend the execution, arguing that Texas planned to use pentobarbital, the same drug involved in Pike’s failed execution attempt. They raised concerns that the state’s supply of the drug may have deteriorated and argued that Howard could face similar complications.
The appeals were rejected twice by the courts, while the U.S. Supreme Court also declined to intervene late Wednesday, clearing the way for the execution to proceed.
Howard’s legal team had also appealed directly to Texas Governor Greg Abbott, asking him to grant a 30-day delay to allow them to obtain additional information about the pentobarbital intended for the execution. The governor did not grant the request.
Convicted Over 2000 Murder
Howard was sentenced to death for the murder of 42-year-old convenience store clerk Vickie Swartout during a robbery in Texas in 2000.
According to reports, Howard was 20 years old at the time of the crime. He shot Swartout while robbing the convenience store and escaped with a carton of cigarettes and $114 from the cash register.
More than two decades later, Howard faced execution for the crime.
Final Apology
Before his execution, Howard was given an opportunity to make a final statement. Swartout’s family was reportedly present in a witness room.
In an emotional statement, Howard apologized to the victim’s family and asked for their forgiveness.
He said he wished they would accept his apology and expressed hope that they would eventually be able to forgive him for what happened.
Howard was subsequently administered the lethal injection and was pronounced dead at 8:03 p.m. local time.
